1. General Terms
This document containing the terms and conditions of use of the website sikariodental.com (hereinafter referred to as the “Terms and Conditions”) establishes the conditions under which any person may visit or access the site sikariodental.com, or may in any way use the services provided through the Site.
For the purpose of these Terms and Conditions: “Site” shall mean the website sikariodental.com; “Site Administrator” shall mean CABINET MEDICAL INDIVIDUAL DENTAR DR. BREBAN – CIRȚIU CARMEN, with registered office in Baia Mare, Str. Ștefan Luchian, no. 10A, Maramureș County – Basement; “Service” shall mean any service offered on the Site and/or any module or component thereof; “User” shall mean any person who visits or accesses the Site, creates an account on the Site, or wishes to use or actually uses the Service in any way.
Failure to accept these Terms and Conditions or any provision thereof, as drafted in this document, obliges the User to immediately cease accessing the Site; continued access or visitation of the Site, of any of its pages and/or use of the Service or any of its components constitutes full and unconditional acceptance of the Terms and Conditions and of any provision therein.
By registering, the User fully and unconditionally accepts the provisions of these Terms and Conditions and agrees to use the Service in strict accordance with them. Users understand and agree that continued use, access or visitation of the Site, of any of its pages and/or use of the Service or any of its components constitutes full and unconditional acceptance of the Terms and Conditions and of any provision therein; refusal to accept the Terms and Conditions obliges such Users to immediately cease accessing the Site.
2. Rights over the Site Content
The content and graphical elements of the Site, including but not limited to the entire text content and any other material transmitted in any form to and from Users (via direct display on the Site, newsletters or any other materials directly or indirectly related to the Site) belong to the Site Administrator and its partners and represent the content of the Site.
By exception, materials for which another rights holder or source has been indicated on the Site, as well as opinions and/or comments of any kind expressed by Site Users, do not belong to the Site Administrator or its partners. Where Site content, regardless of its area or type, is taken over by the Site Administrator from other content producers/issuers (text, images, graphics, video sequences, etc.), such reproduction is done in compliance with the legal provisions and applicable rules.
Users understand and agree that all information, data, and materials posted on the Site are for informational and guidance purposes only, and that the Site Administrator cannot be held liable in any way for the accuracy or validity of the Site Content, or for any legal effect resulting from its use.
Responses received following the completion of the mini-consultation form do not constitute a real medical consultation, and the Site Administrator cannot be held responsible for such informal responses, which are purely informational and do not represent adequate medical treatment.
Users undertake to respect all copyright and related rights as well as any other intellectual property rights held by the Site Administrator and its partners in connection with the Site, its Content, the Service, any module or component thereof. Users understand and agree that any breach of the above provisions may result in liability towards the authors/owners of the Site Content.
The Site Content may only be used for personal, non-commercial purposes, with no direct or indirect intention of obtaining profit or gain. Any use of content by third parties for purposes other than personal requires the prior, express, written consent of the Site Administrator.
It is forbidden to copy, reproduce, publish, transmit, sell, distribute (in whole or in part, modified or not) the content of the Site for purposes other than personal use. The Site Administrator reserves the right to take legal action against any person or entity that violates these provisions. Requests for use of Site content for purposes other than personal can be sent to manager@sikariodental.com (contact person: Cristian Breban), or through any method indicated on the Contact page of the Site.
Users who send information or materials to the Site undertake not to prejudice in any way the copyright or other rights that a third party might claim in relation to those materials, and understand and agree that they alone are liable for any breach of this obligation.
Users who send any kind of content to the Site agree to exclusively transfer to the Site Administrator, indefinitely and worldwide, all rights of use, adaptation, modification, and retransmission of the content they contribute or post. The Site Administrator cannot be held responsible for damages caused by content posted or uploaded to the Site by Users.
It is strictly forbidden to post on the Site any content (including text, images, videos, comments, etc.) that contains obscene or vulgar language, illegal, threatening, abusive, indecent, racist, chauvinistic messages, discriminatory content, or which violates any human rights and freedoms under applicable law.
Users understand and agree that in the event of any breach of the Terms and Conditions, the Site Administrator may, at its discretion, choose not to publish or to modify any content sent by Users without prior notice and without any further formalities.
3. Links to Other Websites
Users understand and agree that the Site may contain links or references to other websites, including personal blogs or supplier websites of products/services to which advertisements on the Site redirect, as well as advertising microsites, considered useful by the Site Administrator in connection with the Site Content, but not under its control.
The Site Administrator is not responsible for the content or opinions expressed on such websites, nor for their accuracy, and Users understand that such sites are not monitored or verified by the Site Administrator. Including a link to another site does not imply approval by the Site Administrator. Accessing such sites is at the User’s own risk and subject to the conditions imposed by those sites.
4. Limitation of Liability
The Site Administrator does not guarantee, implicitly or explicitly, the content of the Site or that provided by Users. While it will make reasonable efforts to ensure the accuracy and reliability of the Site, errors and omissions may occur.
The Site Administrator does not provide warranties and cannot be held liable for any loss or damage arising from the use of any part of the Site Content, or from the impossibility of using it, or from misinterpretation of its provisions.
Users understand and agree that the Site may be affected by objective conditions and that services are offered “as is” and “as available.” Use of these services is at the Users’ own risk.
The Site Administrator cannot be held liable for interruptions, errors, viruses, unauthorized access, strikes, or any force majeure event.
Users agree to indemnify and hold harmless the Site Administrator, its operators, directors, employees, subsidiaries, representatives from any claims, damages, costs, or legal actions arising from misuse of the Site.
5. Applicable Law. Disputes
The rights and obligations of Users and the Site Administrator, as well as all legal effects of these Terms and Conditions, shall be governed by Romanian law. Any dispute shall first be resolved amicably. If no agreement is reached, the competent Romanian court in Bucharest shall resolve the matter.
6. Modification of the Terms and Conditions
The Site Administrator reserves the right to modify these Terms and Conditions at any time, without prior notice. Any change is considered fully and unconditionally accepted by Users through continued use or access of the Site or Services. Refusal to accept changes obliges the User to immediately cease accessing the Site.
